Since the EU Medical Device Regulation (MDR) 2017/745 replaced the old Medical Device Directive, European importers and distributors of surgical instruments carry more responsibility than ever. If you buy instruments from a manufacturer outside the EU, such as in Sialkot, Pakistan, you need to understand how the MDR applies to your products and your role in the supply chain.
How are surgical instruments classified under the MDR?
Most hand-held surgical instruments, such as scissors, forceps, needle holders and retractors, are Class I devices. Under the MDR, reusable surgical instruments form a special sub-category known as Class Ir. For these, a Notified Body must assess the aspects related to reuse, in particular cleaning, disinfection, sterilisation, maintenance and functional testing, and the related instructions for use.
Single-use sterile instruments are typically Class Is, where the Notified Body assesses sterility. Instruments with a measuring function would be Class Im. Electrosurgical instruments such as bipolar forceps are generally classified higher because they are used with active devices.
Key roles in the MDR supply chain
- Manufacturer: the company placing the device on the market under its own name, responsible for technical documentation, the quality management system, the EU Declaration of Conformity and CE marking. If you sell instruments under your own private label, you may be considered the legal manufacturer.
- Authorised representative (Article 11): a manufacturer outside the EU must appoint an EU-based authorised representative.
- Importer (Article 13): the EU company first placing a non-EU device on the market. Importers must verify CE marking, the Declaration of Conformity, labelling, UDI and the authorised representative, and add their own name and address to the device or packaging.
- Distributor (Article 14): must verify that products are correctly marked and labelled and that storage conditions are maintained.

Other MDR requirements to plan for
- PRRC (Article 15): manufacturers and authorised representatives must have a Person Responsible for Regulatory Compliance.
- UDI: Unique Device Identification on labels and, for reusable instruments, often directly on the instrument.
- EUDAMED: the European database for registering economic operators and devices.
- Post-market surveillance and vigilance: procedures for complaints, incidents and field safety actions.
- Instructions for use: including validated reprocessing instructions for reusable instruments.
