The United States is one of the largest markets for surgical and dental instruments, and much of its supply is manufactured abroad, including in Sialkot, Pakistan. Before importing, it is important to understand how the US Food and Drug Administration (FDA) regulates these products and what your manufacturer should provide.
How the FDA classifies surgical instruments
The FDA classifies medical devices into Class I, II and III by risk. Most manual surgical instruments, such as scissors, forceps, needle holders, retractors and many dental hand instruments, are Class I devices. Many Class I devices are exempt from premarket notification (510(k)), although they remain subject to general controls such as registration, listing, labelling and applicable quality system requirements. Some instruments, for example certain electrosurgical devices, may fall into Class II and require a 510(k). Always check the specific product code in the FDA classification database.
Establishment registration and device listing
- Foreign manufacturers of devices intended for the US market must register their establishment with the FDA and list their devices, renewing annually.
- Foreign establishments must designate a US agent located in the United States.
- Importers of record also have registration and reporting responsibilities.
- Registration is not FDA approval. The FDA does not issue “certificates” of registration, so be cautious of suppliers who claim to be “FDA approved” for Class I instruments.

Labelling and UDI
Devices sold in the US need English labelling with the manufacturer’s name and address. Under the FDA’s Unique Device Identification (UDI) rule, many devices require a UDI on the label, and reusable devices may require direct marking. Requirements vary by class, so confirm what applies to your products.

FAQs
Do surgical scissors need a 510(k)?
Most manual surgical scissors are Class I and 510(k)-exempt, but you should confirm the exact product code in the FDA database.
Is FDA registration the same as FDA approval?
No. Registration and listing tell the FDA who makes the device and what it is. It does not mean the FDA has approved or certified the product.
